Elderly Resident Tied to Her Recliner With a Bedsheet by Two New Jersey Nursing Home Workers, says Attorney General

Two employees of a New Jersey nursing home have been named in a 10-count indictment accusing them of assaulting a 93-year-old woman they were meant to be caring for at the home, says a Patch.com article.

As announced by the state attorney general’s office in July, Maria Alcantara, 53, and Joseph Robles, 23, both workers at Alcoeur Gardens, a memory care facility in Toms River, are charged with tying the elderly resident to a recliner with a bed sheet in mid-January and then not checking on her, according to court documents. Beyond this charge of blatant nursing home malpractice, Alcantara and Robles are accused of creating false records saying they checked on her every 30 minutes when they neglected to do so, according to state investigators.

This sort of falsification of records is a lesser known type of nursing home malpractice called false charting. Nursing home workers engage in false charting for the purpose of concealing mistakes and hiding neglect. False charting unfortunately enables workers to engage in prolonged poor care, endangering the health and well-being of residents. This particular type of nursing home malpractice can have the following negative impact on vulnerable elderly residents:

  • two counts of assault on an institutionalized or elderly person

According to the article, both Alcantara and Robles have pleaded not guilty.

New Jersey Nursing Home Worker Indicted for Assaulting Resident with Bleach Spray

New Jersey nursing home worker indicted by a grand jury for abuse of a patient after spraying an elderly resident with bleach, says a Patch.com article. According to the article, Simone Goldsboro, 34, a worker at Dwellside Care & Rehab in Cherry Hill, New Jersey, sprayed bleach on a female nursing home resident’s face and body, a shocking act of nursing home malpractice. Goldsboro furthermore “purposely or recklessly” caused bodily injury by pulling the resident’s hair and aggressively undressing her, said the New Jersey Office of the Attorney General (OAG). Goldsboro was charged last August with aggravated assault for the incident of nursing home malpractice.

According to an affidavit referenced in the article, police received word that a Dwellside worker had reportedly been routinely assaulting a patient; they responded by meeting at the home with the aforementioned victim’s daughter, who claimed to have witnessed nursing home malpractice in the form of abuse against her mother. The daughter shared with the authorities a video recording she had made showing Goldsboro pulling her mother’s hair, yanking a shirt over her head and face, and using a spray bottle to spray a liquid—later determined to be bleach—directly onto the patient’s face and body.

This incident of nursing home malpractice illustrates classic physical nursing home abuse. New Jersey Nursing Home Residents Sue for Negligence, Hardship, and Wrongful Death after Home Closes without Notice

For months before the sudden shutdown, red flags about Princeton Care Center were apparent, including staffing shortages, unpaid bills, and poor ratings related to nursing home malpractice,

Eleven lawsuits have been brought against a New Jersey nursing home, all of which claim it illegally closed without proper notice, a NJ.com article reports. The lawsuits, brought by residents or their families, claim that the precipitous shuttering of doors at Princeton Care Center caused hardship and wrongful death, necessitating the securing of wrongful death attorneys and constituting a blatant act of nursing home malpractice.

In the state of New Jersey, the law dictates that a nursing home intending to close must submit a closure plan and give 60 days’ notice to residents. According to the article, the 72 residents of Princeton Care were given just hours of notice when Princeton Care announced it was closing last September. After the closure, says the article, the majority of the residents were placed in other nursing homes, where they promptly suffered mental deterioration trying to acclimate to new surroundings. Two of the residents died shortly after being relocated, unfortunately requiring their families to secure a wrongful death attorney.

The nursing home malpractice lawsuits against the home charge the facility’s owner, administrators, and health care providers with the following:

It presents too serious of a risk to allow them to have influence over any other Medicaid-funded nursing homes.”

Plea Deal Rejected by Federal Judge for Infamous New Jersey Nursing Home Operator

After establishing Skyline Healthcare, Joseph Schwartz’s nursing home chain rapidly expanded; by 2017 the operator was running 95 facilities in 11 states from his office above a New Jersey pizzeria. But thanks to alleged fraud, mismanagement, and serious resident neglect amounting to nursing home malpractice, the empire swiftly crumbled, displacing hundreds of elderly residents and leaving state regulators across the country to pick up the pieces.

A federal judge has rejected the plea deal negotiated for a New Jersey nursing home operator who admitted he devised a $38 million tax scam to finance a massive nursing home chain that collapsed after rampant, unchecked growth, a NJ.com article reports.

Joseph Schwartz, 64, the former CEO of the now-defunct nursing home chain Skyline Healthcare, pleaded guilty in January to failing to pay employment taxes withheld from Skyline employees and also to failing to file annual financial reports related to his employees’ 401k plan with the Department of Labor. Under the terms of Schwartz’s plea deal, which was negotiated between defense counsel and federal prosecutors, he would serve a year and one day in prison and pay $5 million in restitution; however, on May 23, U.S. District Judge Susan Wigenton threw out the plea agreement and said Schwartz has until June 21 to retract his guilty plea. If he does not, sentencing will go as scheduled on July 17.

According to the article, court filings claimed Skyline Healthcare used a number of shell companies that existed only nominally and for the sole purpose of avoiding accountability and liability.

Beyond its failure to pay vendors, utilities, landlords, or wages to its staff, Skyline’s nursing homes subjected residents to a range of undesirable conditions equating to nursing home malpractice, including food shortages, drastic cuts in resources, staffing issues and cuts, and alarming reports of serious neglect including the following instances of nursing home malpractice:

  • In Arkansas Skyline facilities: heightened unnecessary falls, unbathed residents, and gross neglect. One serious incidence of nursing home malpractice involved a resident had maggots living in their medical equipment; another involved a resident who was ignored for 45 minutes after falling to the floor and injuring his face.
  • In Massachusetts Skyline facilities: drastic staff reductions and the rationing of adult diapers, leaving residents sitting in their own urine and filth, a dangerous example of nursing home malpractice that can lead to bed sores and infection.
  • In a Tennessee Skyline facility, a grave incident of nursing home practice involved a resident who’d undergone a leg amputation and was discovered lying in his own feces with maggots and gangrene in his leg. The man died two days later, a circumstance that merits the involvement of a wrongful death attorney.

Ninth Wrongful Death Lawsuit Filed in Connection with Pennsylvania Nurse Charged with Killing Two Nursing Home Residents and Attempted Murder of a Third

The latest lawsuit involving Heather Pressdee, the former registered nurse charged with homicide and attempted murder, claims that her being fired or forced to resign from multiple nursing homes was a red flag indicating a history of nursing home malpractice.

A new wrongful death lawsuit has been filed against a Pennsylvania nursing home in connection with former nurse Heather Pressdee, says a Trib Live article, marking the ninth wrongful death lawsuit against a nursing home where Pressdee worked.

Pressdee is criminally charged with killing two nursing home residents and attempting to murder a third by giving them lethal doses of insulin at Quality Life Services, a skilled nursing facility near Pittsburgh. This act of nursing home malpractice was called “deliberate and intentional” by the Pennsylvania attorney general. According to the Trib Live article, Pressdee has been connected by state prosecutors to the deaths of at least 17 patients, and the mistreatment of five more, at nursing homes across four Pennsylvania counties between 2020 and 2023. She is being held in the Butler County jail.

The latest suit brought by a wrongful death attorney has been filed against Armstrong Rehabilitation and Nursing Facility in Kittanning, Pennsylvania, and its parent company, Armstrong SNF Operator LLC, on behalf of patient Louise Skinner, 90, who died in December 2022. The suit claims Skinner, like Pressdee’s other alleged victims, died from an overdose of insulin administered by Pressdee and that Armstrong Rehabilitation is liable; it accuses the facility of nursing home malpractice in the form of negligence due to the fact that the home hired Pressdee in November 2022 despite her string of dismissals and resignations from other nursing homes.

The suit furthermore accuses Armstrong Rehabilitation staff of nursing home malpractice in the form of negligence in that it failed to prevent Pressdee from giving unnecessary insulin to Skinner, and in that it neglected to report or act on reports regarding suspected abuse. In total the lawsuit brought by the wrongful death attorney contains nine counts, including negligence and vicarious liability.

According to the article, the eight other wrongful death lawsuits connected with Pressdee make similar claims of liability against two other Pennsylvania nursing homes and their owners. They have been brought against Belair Healthcare and Rehabilitation Center in Lower Burrell and Sunnyview Rehabilitation and Nursing Center in Butler.

Nursing Home Fined for Regulatory Violations after a Falling Incident Leads to a Resident’s Death

Three deaths in three years have resulted in state citations against Iowa’s Northridge Village, indicative of the occurrence of nursing home malpractice as well as circumstances that merit the involvement of a wrongful death attorney.

An Iowa nursing home fined for a regulatory violation in connection with a resident’s falling death, says an Iowa Capital Dispatch article. Northridge Village, a care complex comprised of a state-licensed assisted living center and nursing home fined $6,000 for the incident of nursing home malpractice.

According to the article, a female assisted living resident who had been equipped with a 24-hour emergency response pendant was discovered on the floor of her apartment on Sunday, Dec. 31, 2023, injured after a fall. The woman, who had gone on a shopping trip the previous Friday, had reportedly been unreachable by phone all weekend; when a family member checked on her, the apartment was locked and staff was required to get inside. At the hospital the woman was determined to have seven cracked ribs and to be suffering from dehydration and atrial fibrillation. Transferred to a hospice unit, the woman died days later.

While the inspectors’ report did not indicate when the woman fell or how long she lay on the floor before being discovered, it did say that the woman’s emergency response pendant had at some point been mistakenly deactivated. As a functioning pendant is a regulatory requirement for Iowa assisted living facilities, the incident is a clear occurrence of nursing home malpractice, one that would understandably warrant the contacting of a wrongful death attorney.

According to the article, Northridge Village has been cited twice in recent years for wrongful deaths in its skilled nursing facility:

  • In November 2021, a resident died after being dropped to the floor during an improper bed transfer.
  • In November 2022, a resident died following an untreated urinary tract infection.

Iowa Nursing Home Cited by State for Resident’s Death from COVID: 

Upon investigating the suspected wrongful death of a male resident of Regency Care Center, state inspectors discovered numerous un-investigated nursing home malpractice complaints against the facility.

An Iowa nursing home has been cited by the state for causing the death of a resident with COVID, says an article on Iowa Capital Dispatch. As per the article, Iowa state inspectors say a male resident of the Regency Care Center in Norwalk, who was suffering from COVID-19, was not properly assessed by staff and later died from respiratory failure as a result of that negligence.

According to state inspectors’ reports, the man, who had just tested positive for COVID-19, was experiencing shortness of breath on Dec. 4 of 2022. Despite a worker’s report to a nurse that the man’s lungs rattled loudly and he “looked like death,” the nurse responded that the symptoms were typical of the illness and took no further action. The next day the resident was taken by ambulance to the emergency room, where he died hours later of a combination of chronic respiratory failure and viral sepsis resulting from COVID-19.

Inspectors reported that negligence on the part of Regency Care’s nursing staff amounted to nursing home malpractice to the extent of causing the wrongful death of the resident; furthermore, this circumstance of negligence and nursing home malpractice placed the other residents of the facility in immediate jeopardy. While performing their investigation of the resident’s death, state inspectors discovered several pending complaints against Regency Care, the large majority of them substantiated.

Tennessee Nursing Home Resident with Dementia Dies after drinking Laundry Detergent:

The wrongful death lawsuit brought against Prosperity Pointe, an assisted living and memory care facility in Knox County, claims negligence amounting to nursing home malpractice resulted in the resident’s death.

A nursing home malpractice and wrongful death lawsuit has been brought against a Tennessee nursing home after a resident with dementia drank laundry detergent and died, says a news article on wbir.com. According to the complaint filed against Knox County’s  Prosperity Pointe by the deceased’s family, negligence on the part of the assisted living and memory care facility created the circumstances under which Benny McDaniel died of poisoning from drinking laundry detergent.

According to the lawsuit, on March 19, McDaniel, who was diagnosed with both Alzheimer’s and dementia and resided on the memory care floor at Prosperity Pointe, gained access to the laundry room as the result of a broken door and drank laundry detergent. McDaniel died of poisoning on March 28. The complaint argues that since the facility was aware of the broken door, it thereby “created the dangerous condition” that enabled McDaniel to access the laundry detergent. This careless act of nursing home malpractice by Prosperity Pointe, says the lawsuit, demonstrated “intentional and reckless disregard for safety” and amounts to negligence according to Tennessee law.

The article referenced an American Association of Retired Persons (AARP) health article on dementia patients that outlines the risks laundry detergent, especially laundry pods that might resemble candy, poses to dementia patients. According to the AARP article, 75 percent of deaths associated with highly concentrated detergents are dementia patients.

Nursing homes are required by law to meet the care needs of each of its residents. This requirement includes providing safe conditions for residents, particularly those living with Alzheimer’s or dementia, who need specialized care and attention. Hospitalized Residents’ Serious Health Problems went Undetected by North Carolina Nursing Home, State Inspection Report Finds

The Hunter Woods Nursing and Rehabilitation Center in Charlotte, North Carolina, has been repeatedly cited for violations amounting to nursing home malpractice by regulators, and scores a single star out of five in the Centers for Medicare and Medicaid Services 5-Star Quality Rating System.

At least two hospitalized residents of a North Carolina nursing home had serious health conditions that went undetected by staff, says a recent Charlotte Observer news article. According to state inspection reports by the North Carolina Department of Health and Human Services, two residents of the Hunter Woods Nursing and Rehabilitation Center in Charlotte were subjected to nursing home malpractice when nursing home staff failed to recognize serious medical conditions that eventually landed them in the emergency room. One of these residents later died.

One of the cases of nursing home malpractice at Hunter Woods as determined by inspectors involved a 92 year-old female resident who, after becoming unresponsive following plummeting blood pressure in mid-April, was rushed to the hospital and discovered to be suffering with severe sepsis, a life-threatening condition, as the result of the seriousness of her infected wounds. The woman had both an infected pressure wound on her buttocks and a wound on her heel that had developed into a bone infection. According to the article, the nursing home’s reports on the woman’s foot wound prior to the hospitalization varied from “no issues” to the recognition of an open wound. The nurse responsible for monitoring the woman for skin issues noted, but did not change, the bandages on the foot wound. After several more trips to the hospital and a brief stay at another nursing home, the woman passed away in June . Her death certificate says she died from dementia. According to the article, the woman’s family members have secured a wrongful death attorney in the hopes of holding the home accountable for her death.

Deteriorated bedsores are a common occurrence at nursing homes, and almost always are the result of nursing home malpractice. When pressure ulcers deteriorate and become bone-deep infections, they can become life-threatening, potentially requiring the involvement of a wrongful death attorney, as is the case with the aforementioned resident at Hunter Woods.

Another instance of nursing home malpractice cited by North Carolina inspectors includes the hospitalization of a Hunter Woods resident with diabetes whose sugar levels had not been monitored and had soared to dangerous levels. According to the article, a third Hunter Woods resident in her early 30s who arrived at the home after suffering a stroke, went three months with an undetected dislocated shoulder after suffering numerous falls at the home. This same resident, dependent on a feeding tube, at one point lost nearly forty pounds and suffered from malnutrition.

In response to Hunter Woods’ failure to care for the woman with severe wounds, inspectors cited the nursing home with a “Level G” breach, a serious violation that indicates “actual harm” was done to a resident. Responding to the home’s nursing home malpractice as it relates to the resident with diabetic ketoacidosis, the home was cited by inspectors with the most severe violation: “immediate jeopardy to resident health or safety.”

Battering a Resident with Dementia Charged to Virginia Nursing Home Employee

Camera footage reveals a nursing home worker grabbing an elderly resident’s wrists, engaging in verbal abuse, and otherwise committing nursing home malpractice at Brickyard Healthcare in Richmond, Virginia.

A now-former employee at a Virginia nursing home has been charged with battering a resident following multiple incidents of nursing home malpractice captured on video, says an article on Pal Item. Cody A. Madden, 33, since fired from his position as a certified nurse’s aide at Brickyard Healthcare in Richmond, faces felony charges of battery against an endangered adult after allegedly having “verbally accosted and possibly physically battered” a male resident.

According to the article, the camera that recorded footage of a staff member identified to be Madden was installed by the alleged victim’s daughter, who had suspected nursing home malpractice was taking place against her father. The captured video shows the alleged victim, who reportedly suffers from dementia, enduring various episodes of verbal abuse and having his wrists seized by Madden. According to the daughter, the act left bruises on her father’s wrists.

Among the verbal abuse equaling nursing home malpractice reportedly captured on the video is Madden calling the elderly man a “punk” and telling him he had come to his room “to set you straight” and threatening to shove his foot inside the man “so high that I’ll be wearing you as a slipper, man.”
